Josh Wolf going back to Prison
It seems that Josh Wolf is going back to prison, as he plans to not comply with a grand jury subpoena for his unpublished footage. It’s still not clear to me what principle(s) he is protecting in this matter. From what I’ve gathered this footage would not have been protected by the California Shield Law, the 9th Circuit most likely ruled on this point (I have not had a chance yet to read the opinion).
Regardless, if any court was going to see the possibility that there was merit to this case it would have been the 9th Circuit. Who knows where this will fallout, certainly bloggers all over the world are watching.

Bloggers can watch, but I hope not for indications of how this might effect emerging blog-related law, since it doesn’t really come up here.
As far as I can figure, since this case is based on federal law - which got it to federal court and in front of the 9th Cir - whether or not the CA law applies is irrelevant since there is no analogous federal shield law.
it might seem like he’s making a noble stand against the man, but i think the more correct conclusion is that his case has nothing but bad facts for anything he might be wanting to accomplish. in fact, as these things go, it’s better if the court doesn’t touch it than if they do and the create some really bad law.
